The 商店和機構 Act is a state-specific statute that varies each state. The goal is to manage and enhance workers’ working conditions and rights, such as wage payments, leaves, holidays, and work hours, among other things.

The registration under the 商店和機構 Act is administered by the individual state’s labor department, and it is required for any commercial enterprises that do not come under the purview or application of The Factories Act, 1948. Applicability

Applies to all commercial establishments such as stores, offices, schools, hospitals, organisations, charity trusts, and educational institutions that operate for profit. However, factories are exempt from the Shop and Establishments Act and are governed by the Factories Act of 1948.

Meaning of Shop

A location where a trade or business is conducted or where consumers are served. It includes offices or warehouses used in conjunction with such trade or business, whether on the same premises or not, but does not include a shop or office linked to a factory within the scope of the Factories.

Commercial Establishment

A commercial or trading or banking or insurance establishment, an establishment or administrative service in which persons employed are primarily engaged in office work, a hotel, restaurant, boarding or eating house, etc., a cafe or any other refreshment house shall be considered a Commercial Establishment.

Time to Apply for Registration

The application for Shops and Establishment Registration must be filed with the Labour Department, which has authority over the company’s or LLP’s registered office, as well as any other place of business where employees are engaged. The application must be submitted within 30 days of the business’s inception.
