A PSARA license is required before starting a private security firm in India. The term “Private Security Agency” refers to a company that provides security guards and other associated services at a business as an alternative to the police. The Private Security Agencies Regulation Act, 2005, often known as PSARA, governs the functioning of private security agencies.

Following the introduction of the PSARA (act), it is required for a security agency to get a licence from the State Controlling Authority Concerned before to beginning operations, and the legislation provides for severe penalties in the event of noncompliance. The application for a licence to create a private security agency is made to the state’s competent authorities. The PSARA License is valid for one or more districts of a certain state, or for the whole state.

Applicability

An Individual, Partnership Firm, Person Company (OPC), or Private Limited Company can apply to the Competent Authority of the concerned state for a PSARA Licence/Registration.

Name & Object of Applicant

The entity’s name should include the words Security Services or related keywords that describe the applicant’s goal. In the case of a company, one of the Main Objects must be the provision of security services.

Eligibility of Director / Principal Officer

For police verification, the applicant must be a Resident Indian, in good financial standing (we must produce a copy of their ITR), have a clean antecedent, and have never been convicted of any crime.

MOU with Training Institute

To train security guards, the applicant for a PSARA Licence must engage into an MOU with a training institute or an organisation certified by the state regulatory authority. Ex-training servicemen’s requirements have been relaxed.

National Interest Clause

The PSARA License cannot be awarded to a person if they are discovered to be maintaining links with organisations or associations that are prohibited under any legislation or by a government order to defend national security, public order, or to prevent any action that is detrimental to national security.

Restriction of Foreign Investment

Section 6(2) of The Private Security Agencies (Regulation) Act, 2005 states that the PSARA Licence would not be awarded if the company is not registered in India or has a proprietor, majority shareholder, partner, or director who is not an Indian citizen. Details may be found in the FAQ.
